From Tradition to Modern Equality

Foreign nationals can legally marry in England, provided they comply with the same requirements as British citizens. However, additional immigration checks apply if either party is subject to immigration control. Both partners must give notice of marriage at a designated register office. The Home Office may extend the notice period to 70 days to ensure the marriage is not one of convenience. If immigration authorities suspect that the marriage is intended solely for visa or residency purposes, the Home Office has the power to investigate and, in some cases, refuse permission for the ceremony until further verification is completed.

The marriage is valid under the law of the country where it took place (lex loci celebrationis). Both parties had the capacity to marry according to English law at the time. Couples who marry overseas should ensure they obtain an official marriage certificate and, where necessary, have it translated and legalised for use in the UK. Polygamy refers to being married to more than one person at the same time. It is not legally recognised in England.
